Rescue Terms and Conditions

Once you’ve been a driver with Taxify for greater than a month, you can use the Rescue services described below by tapping the SOS button on the driver application.

1. DESCRIPTION OF SERVICES
1.1. In the event of a Serious Medical Incident or Security Incident, Rescue will send an ambulance and/or Security escort vehicle to the scene.

1.1.1. A Serious Medical Incident is one that requires hospitalization and may result, for example, from a road accident. Rescue will send an ambulance to the scene and stay with you until you are admitted to the hospital.

1.1.2. A Serious Security Incident is when you are in an unsafe situation or location. These may result from a passenger threatening you or arriving at a pick-up location and realizing it’s an unsafe situation.  During these incidents, Rescue will send a security escort vehicle.

1.2. Services are provided when the driver is on an active Taxify trip.

1.3. Services are provided when the driver has been active on Taxify for more than a month (30 days).

1.4. Services are provided only within the following Geographic Scope: the county of Nairobi and Kikuyu, Ngong, Rongai, Mlolongo.

2. DRIVER DATA AND PERSONAL INFORMATION

2.1. By using the SOS feature, if it is ever used, and without needing further permission, drivers agree to share the following with Rescue and Taxify: personal information used to identify and locate them, information pertaining to the emergency, their real-time location and their current online or on trip status and any needed medical information which assists in the services.

2.2. By using the SOS feature, drivers agree that some information shared with Rescue during the emergency can be shared with Taxify for the purposes of billing

3. PROGRAM LIMITATIONS

3.1. Requests deemed by Rescue to not be a Serious Medical Incident or Security Incident which may attract additional fees s which will be paid by the driver.

3.2. Requests for an ambulance or security escort services for someone besides yourself (the driver) These may include for your friends, families, or strangers, which will attract additional fees to be paid for by the driver.

3.3. Requests for an ambulance for emergencies at home or anywhere when the driver is not on a trip or online will attract additional fees to be paid for by the driver.

3.4. For requests made when the driver is not on an active Taxify trip, Taxify will charge you for the cost of the evacuation.

3.5. Requests, when the driver has not been continuously active on the Taxify application for more than one month, are eligible to receive Services under this Agreement.

3.6. By using the SOS feature, drivers agree that some information shared with Rescue during the emergency can be shared with Taxify for the purposes of billing

4. EXCEPTIONS

The following are excluded and will not be provided under this agreement:

4.1. Any services to an individual that cannot be verified as a driver or eligible to receive Services.

4.2. Any event occurring when a driver is outside the Geographic Scope of Service.

4.3. Any expense incurred for Intervention if a driver is not suffering from a Serious Medical Condition or in response to a Security Incident.

4.4. Any expense related to the driver engaging in the commission of, or the attempt to commit, an unlawful act.

4.5. Any expense related to a driver participating in civil unrest, terrorist or militia activity.

4.6. Any expense incurred as a result of the driver engaging in active service in the armed forces or police of any nation; active participation in war (whether declared or not), invasion, the act of foreign enemy, hostilities, terrorist, counter-terrorist, civil war, rebellion, riot, revolution or insurrection.

5. PAYMENTS AND FEES

5.1. When the driver is on an active trip, Taxify will pay for the ambulance and/or security escort if there is a Serious Medical Incident or Serious Security Incident.

5.2. Taxify reserves the right to withhold driver's payouts and to charge the driver for any Rescue services owed by the driver.
